Afghan Bios Insider View: The High Office of Oversight for Anticorruption seems to be a catchy name but the fact is that they could only use their influence on smaller entities till 2016. Corruption cases to be investigated were decided on case basis. If the corruption involves high level people in the government, it was ignored.

Sayed Ghulam Hussain Fakhri Ghulam Hussain Fakhri was born 1951 in Benisang, village of Jaghato district. He joined the Police Academy immediately after graduating from high school and later became a Professor of the Academy. In the 1980s until 1993, he served in a variety of roles in Afghanistan: he was the Head of the National Security Directorate, Deputy Attorney General, and Attorney General of the Armed Forces. He migrated to Peshawar, Pakistan with his family during the civil war. From 1996-2001, he was the manager of "Cooperation", a magazine published by the NGO Cooperation Center for Afghanistan (CCA). Fakhri returned to Afghanistan after the fall of the Taliban and rejoined the National Security Directorate, where he was appointed Deputy Director in 2010, before being appointed Director-General of the High Office of Anti-Corruption. has served as a senior military General during Dr. Najibullah’s government. He has also served in the Afghan intelligence department – National Directorate of Security (NDS) for many years, and was recently appointed as deputy NDS chief.(20140101)

Farkhri said that the office of oversight and anti-corruption of Afghanistan is only able to collect evidences against the corruption officials, which will be used once an open environment is provided by the government of Afghanistan to fight corruption. He said the office of oversight and anti-corruption of Afghanistan does not have an open hand, and can not act independently against the corrupt individuals and officials.(20140101)

The High Office of Oversight and Anti-Corruption (HOOAC) said that ethnic and political meddling in the work of judicial institutions has delayed legal procedures against those involved in embezzlement and corruption in the country. Failure to follow up on corruption cases in the ministry of urban development affairs is debatable, said Lieutenant General Sayed Ghulam Hussain Fakhri, Director General of the High Office of Anti-Corruption. "Persistent delays have been made in these cases like other major cases of corruption," Fakhri said, referring to the corruption cases against six defendants in the ministry of urban development affairs and housing scandal who were dismissed from their posts by President Ashraf Ghani a year ago (2015). "Until now the court has not issued its verdict and people are not satisfied with the investigations so far," he added. The suspended officials include Ahmad Shah Hemat, Urban Development Director, Gul Rahim Ziarmal, Plan and Policy Director, Mohammad Aminullah Qani, Head of Apartments Cohesion, Mohammad Aminullah Amin, Director of Property and Accommodation and Ahmad Nawaz Bakhtyar, Director of Housing Enterprise, Director Finance Apartments Cohesion Syed Aman Sadat. Lieutenant General Sayed Ghulam Hussain Fakhri, Director-General of the High Office of Anti-Corruption claims that Afghan leaders are waiving from heavy corruption cases in order to secure vote banks in the upcoming presidential elections.(20171215)

 

Background:
President Karzai in July 2008, issued a Decree establishing a High Office for Oversight and Anti-corruption (HOOAC). This law has been enacted in the light of the provisions of Article (7), item (3) of Article (75) and Article (142) of the Afghanistan Constitution and in accordance with the United Nations Convention against Corruption in order to oversee and coordinate the implementation of the Anti- Corruption Strategy. The creation of this Office has fulfilled the requirement of Article 6 of the UN Convention against Corruption.

The High Office of Oversight and Anti-corruption (HOOAC) is the highest office for the coordination and monitoring of the implementation of the Anti-Corruption Strategy and for the implementation of administrative procedural reform in the country. This office shall be independent in carrying out its duties and shall be reporting to the President.

Since corruption is a major cross-cutting issue, the urgent need to have a high-level inter-institutional oversight of the anti-corruption effort was understood, as there was insufficient coordination of efforts and no one existing agency could take the lead on all parts of the agenda. Considering this complex scenario, the HOOAC has been mandated with a unifying oversight function to coordinate, supervise and support all anti-corruption efforts in Afghanistan. The HOOAC shall be the focal point for overseeing policy development and implementation of anti corruption strategies. The HOOAC will strive to bring agencies together rather than competing with them.
